Earthworks Grading and Paving LLC
(NRS 333.182 Compliance)
Earthworks Grading and Paving (“the Company”) is committed to maintaining a workplace that promotes fairness, equity, and equal opportunity for all employees. This policy establishes the Company’s standards and procedures to ensure equal pay for equal work, non-discriminatory employment practices, and compliance with Nevada Revised Statutes (NRS) 333.182, the Nevada Equal Pay Act, and all applicable federal, state, and local laws.
This policy applies to all employees of Earthworks Grading and Paving, including full-time, part-time, temporary, and seasonal employees.
Earthworks Grading and Paving maintains policies and practices requiring equal pay for equal work, regardless of gender. “Equal work” is defined as work that is substantially similar in skill, effort, responsibility, and performed under similar working conditions.
Compensation differences, when they exist, are based only on legitimate, non-discriminatory factors, which may include:
Seniority or length of service
Merit or performance-based systems
Quantity or quality of production
Education, training, or experience directly related to the job
Geographic location or shift differentials
Other bona fide factors consistent with applicable law
Gender is never a factor in determining wages, salaries, bonuses, benefits, or other forms of compensation.
The Company actively works to ensure that average compensation for female employees is not consistently below the average compensation for male employees performing comparable work.
To support this commitment:
Compensation data is periodically reviewed for trends or disparities
Pay structures are based on job duties and qualifications, not gender
Any identified disparities are evaluated to determine whether they are supported by lawful, job-related factors
If an unexplained or unlawful disparity is identified, Earthworks Grading and Paving will take prompt corrective action, which may include wage adjustments or policy changes.
Earthworks Grading and Paving makes all employment decisions without regard to gender, including:
Recruitment and hiring
Job assignments and classifications
Training and development opportunities
Promotions and advancement
Discipline, retention, and termination
Employees are not restricted to specific roles, job classifications, or career paths based on gender. Advancement opportunities are based solely on qualifications, experience, performance, and business needs.
The Company conducts a formal evaluation of wages and benefits at least once every three (3) years to ensure compliance with Nevada law and equal pay standards.
These evaluations may include:
Review of wage rates and salary bands
Analysis of benefits and bonuses
Comparison of compensation across comparable roles
When discrepancies are identified that are not justified by lawful factors, Earthworks Grading and Paving will promptly correct wage or benefit disparities.
Employees have the right to:
Discuss wages and compensation without retaliation
Raise concerns regarding pay equity or discrimination
Request clarification regarding compensation practices
Earthworks Grading and Paving prohibits retaliation against any employee who raises a goodfaith concern or participates in an investigation related to pay equity or discrimination.
Company leadership is responsible for implementing, monitoring, and enforcing this policy. Supervisors and managers are expected to uphold these standards in all employment decisions.
Failure to comply with this policy may result in corrective action, up to and including discipline or termination.
This policy will be reviewed periodically and updated as necessary to remain compliant with Nevada Revised Statutes, federal law, and best practices related to pay equity and workplace fairness.
